Water Seepage with Closing Approaching

Question:

Seller calls and say that there is slight water seepage in their unit from another unit on upper floors just few weeks prior to closing. The damage “might” be fixed before closing.

  1. Should the buyer’s agent be informed by listing agent?
  2. Should seller inform their lawyer to inform buyer’s lawyer?

Answer:

The Seller has an obligation to advise the Buyer.

So, certainly if it’s early, the Listing agent should handle the communication.

If it’s right before closing, turn the matter over to the lawyer. The Listing agent should ensure that this communication has been made and document this disclosure in their file.
