Question:
A house that had 8 inch vinyl tiles and it was presumed to have contained Asbestos. Based on the time period, the house was built in the early 60’s.
The Seller removed the tiles themselves wearing masks.
Should this be revealed by the Seller?
Answer:
It’s possible that there might have been a problem at some point in time.
A Seller has to disclose latent defects, that are significant and that they know about. This situation doesn’t appear to meet that threshold.
If the Buyer is concerned about this and/or related issues, then they can do an inspection. So, here, it would be wise on the part of the Seller to accept such a clause.
