Question:
Kitec plumbing… again!
I’ve seen two units that didn’t disclose on the listing. Should they?
Answer:
Kitec is sometimes a problem, and sometimes not. Rarely is it “latent” in any way. Certainly, it would be nice to know, but there are three people involved here:
1) Seller,
2) Listing Agent, and
3) Buyer’s Agent.
There is a duty upon the Buyer’s Agent to find out and tell the Buyer. The others in large measure can keep quiet if they want to. The Seller doesn’t have to tell anybody and the Listing Agent is under a duty to tell the Seller, but, of course, the Seller already knows!
