With your question, right at the outset you referred to the buyer as a “client”. So, that’s it right from the start. They are a client and agency rules apply.
If there is no such arrangement and you have a prospect and not a client then the crossover to implied agency takes place when your provide:
- advice and/or
- guidance.
Not all agency appointments are created by the agent. The buyer could create agency through “ratification”.
