Witnessing an Agreement in Ontario

Man's Bizarre Signature Confuses People

Question:

The Witness of (or at) an Agreement of Purchase and Sale:

(A) Full legal name of the witness must appear of the agreements.

(B) Any competent person can be witness the agreements

(C) The witness must date his / her signature in the space provided.

Answer:

All three are incorrect.

A witness may sign their ordinary signature. There’s no need for their full legal name.

A witness needs to be over the age of majority, free of conflicts of interest and not under the influence of alcohol, drugs, or other substances which would impair their ability to witness a document.

There is no place on the form for them to “date” their signature.
