What can Assistants Do?

(Ontario)

Question:

I would like to know what things my assistant can do. They are not registered.

Answer:

They can do everything except what is “Trading in Real Estate”.

Here’s the definition.

“trade”

includes a disposition or acquisition of or transaction in real estate by

sale, purchase, agreement for purchase and sale, exchange, option, lease, rental or otherwise and

any offer or attempt to list real estate for the purpose of such a disposition, acquisition or transaction, and

any act, advertisement, conduct or negotiation, directly or indirectly, in furtherance of any disposition, acquisition, transaction, offer or attempt…

The assistant cannot do any of the above.

  1. It is funny isn’t it, an assistant can chauffeur clients to a house, can even open the door but cannot guide them through the house. Yes, I know, they do not have E & O insurance and whatever but is showing someone through a house really a sales action? Especially, silly when considering a vacant home.

In reality, they could do more, but it’s always difficult where to draw the line. So, RECO concludes that this works.
