When is a subdivision home unique?

A Court recently looked at this and concluded:

Uniqueness must take into account:

  1. all the surrounding circumstances,
  2. including the purchaser’s “wish list”,
  3. the market conditions,
  4. the location,
  5. the type of home,
  6. the condition of the home,
  7. the lot,
  8. the finished areas of the home,
  9. the quality of finishes,
  10. the availability of comparable homes with the same attributes in the same price range,
  11. the proximity to certain amenities and so on.
