Important change for real estate agents
The N12 change deserves special attention.
Beginning September 21, 2026, where a landlord gives an own-use notice and:
- the notice is given on or after September 21, 2026;
- the termination date is at least 120 days after the notice; and
- the termination date falls at the end of a rental period or fixed term,
the landlord will not have to pay the tenant one month’s rent or offer another rental unit under s. 48.1.
However, this does not mean that an N12 can simply be used to remove a tenant because the property is being sold. The statutory requirements for an own-use termination remain important, and the LTB can examine the landlord’s good faith.
There is also a new 60-day occupancy presumption: if the qualifying person does not occupy the unit within the prescribed period after the former tenant leaves, the legislation creates a presumption of bad faith unless the contrary is proven.
