Multiple Representation and Referral

Question:

If I sent a buyer referral (a Buyer Representation Agreement was signed previously) to a salesperson (different brokerage) in an area I don’t cover, they find a property but it is listed out of area by one of the sales people from our brokerage just a different location, could it be considered multiple representation since we still have the BRA signed and we are receiving a referral?

Answer:

There is already a BRA in place unless you get rid of it in some way:

1) Cancel it, or

2) Assign it.

Otherwise, you have multiple representation. A Referral Agreement where another Brokerage becomes involved does not affect the fundamental issue of multiple representation in this set of circumstances.
