FAILURE to PROCEED after submitting completed 801
Once a registrant has delivered a notice, that doesn’t mean that the have to proceed to deliver the actual Offer. The Buyer’s agent MUST follow the Buyer’s instructions. If they say “don’t proceed”, that’s it.
That’s the Buyer’s agent’s fiduciary obligation!
Now, the Listing agent might like the Offer to proceed because the number count is higher, but that has nothing to do with the initial registration.
The Offer was:
- Part of the count,
- Now, it’s not.
