Question:

How should someone sign who holds a Power of Attorney?

Answer:

Remember that a POA is a piece of paper, and the person to whom authority was granted is called the “Attorney”

The proper way to sign is:

  1. sign the Principal’s name first,
  2. followed by the “by Attorney’s name”,
  3. followed by, “under POA.” Or “pursuant to POA”

So, for example, if the Principal is Bob and the Attorney is Mary, it would be signed, “Bob Smith by Mary Smith under Power of Attorney”.

Per: “Mary Smith pursuant to POA”

However, it’s not the only way. No matter what kind of a mess people will make, it still seems that most Judges will be able to figure it out.
