Question:
Could or should “Authority to give and receive notices” on behalf of Seller Brokerage’s customer (seller is customer of listing brokerage), or alternatively on behalf of Buyer Brokerage’s customer (Buyer is customer of Buyer brokerage?
Answer:
It is possible to be an “intermediary” for the purposes of a Seller or Buyer who has customer service status.
However, it’s not commonplace. It is not included in any of the OREA Forms.
It’s risky because you may start treating them as a Client which would be “implied agency”. You would have to ensure that you had documentation to prove that this was not the case.
UPDATE: This is now simnply “historical” in nature since “customer service” was eliminated by TRESA effective March 2024.
