Question:

If a client has inherited their parents’ home, and you are listing the home, how do you know the client is legally able sell to the home?

Would lawyer have the title transferred to them at registry office?

Answer:

Not necessarily, sometimes the transfer will be directing from the Estate to the new Buyer.

You will know that the Estate Trustee has the power to sell, if that is set out in the Will. If it is not, then you will have to await a Certificate of appointment.

If there is no Will, then no one has authority to list or sell until there is a Court Order.
