Question:
Our office is on the listing side and sold a property for a home being built. They buyer’s agent, after closing but during construction, has posted his For Sale sign with a SOLD sticker on it. He never had it for sale so maybe he wants to promote that he was on the buying side. Is it allowed in your area? Looking for feedback.
Answer:
There are four sources of rules:
1) REBBA,
2) MLS,
3) City By-laws,
4) Subdivision Restrictive Covenants
There is nothing to prevent this either under REBBA or MLS. If there is a City by-law, it’s designed to prevent anything. They are really not focusing upon the subtleties of listing, selling, co-operating etc.
